01Account terms

By creating an IR Now account, you agree to provide accurate, current, and complete information about yourself and your organization. You are responsible for all activity that occurs under your workspace, including actions taken by users you invite.

Access to IR Now is granted manually after review of your request. You must be authorized to act on behalf of the organization you register. You are responsible for maintaining the confidentiality of your login credentials and for notifying us promptly if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that provide false information, violate these terms, or remain inactive for an extended period. One organization may maintain one active workspace unless otherwise agreed in writing.

02Billing & plans

Paid plans are billed in advance on a recurring monthly or annual basis, depending on the plan selected. Plan limits — including learner seats, course generations, and AI processing credits — reset at the start of each billing cycle.

• Course-generation limits do not roll over between billing cycles.
• Existing courses, learner progress, and issued certificates are retained across plan changes unless the account is terminated.
• You may upgrade, downgrade, or cancel your plan at any time through your account settings. Downgrades take effect at the end of the current billing period.
• Refunds are handled in accordance with the refund policy described in your order confirmation. We do not provide pro-rata refunds for partial billing periods unless required by applicable law.

03Acceptable use

You agree not to misuse IR Now or assist anyone else in doing so. Prohibited activities include, but are not limited to:

• Attempting to probe, scan, or test the vulnerability of the platform or circumvent any security or authentication measures.
• Reverse-engineering, decompiling, or disassembling any part of the service or its underlying technology.
• Using the platform to generate, store, or distribute content that is unlawful, harmful, threatening, abusive, or otherwise objectionable.
• Sharing account credentials with unauthorized parties or reselling access to the platform without our written consent.
• Using automated means (bots, scrapers, crawlers) to access or collect data from the service.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing content, suspending access, and reporting to law enforcement.

04Intellectual property

IR Now and its licensors retain all rights, title, and interest in and to the platform, including its software, design, methodology, underlying algorithms, and documentation. Nothing in these terms grants you any right to use our trademarks, logos, or brand features without prior written consent.

Training content generated for your organization through the platform is licensed to you for internal training use as described in your plan. This license is non-exclusive, non-transferable, and revocable upon termination of your account. You may not sublicense, distribute, or commercially exploit generated content outside your organization without our written permission.

05AI-generated content

IR Now uses artificial intelligence to generate training materials, quizzes, and course content from the organizational information you provide. This content is produced by large language models and is intended as a training aid to supplement — not replace — your organization's incident response program.

While we take reasonable steps to ensure the quality and accuracy of generated content, AI-generated material should be reviewed by a qualified member of your team before use in any official capacity. IR Now does not warrant that generated content is exhaustive, error-free, or suitable for every regulatory context, jurisdiction, or compliance framework.

You acknowledge that AI-generated content may occasionally contain inaccuracies, omissions, or recommendations that may not align with your specific organizational policies or legal requirements.

06Your data

You retain ownership of the organizational information, documents, playbooks, and other data you submit to IR Now ("Your Data"). We process Your Data solely to provide, maintain, and improve the service as described in these terms and our Privacy Policy.

We do not sell Your Data, and we do not use Your Data to train third-party foundation AI models. Your Data may be processed by our AI subprocessors solely for the purpose of generating your organization's training content.

07Limitation of liability

To the maximum extent permitted by applicable law, IR Now and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the service.

IR Now is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. IR Now is a training and readiness tool and is not a substitute for a comprehensive incident response program, professional security services, or legal advice. Your organization remains solely responsible for its incident response capabilities and compliance obligations.

Our total aggregate liability for any claims arising under these terms shall not exceed the amount you paid to IR Now in the twelve (12) months preceding the claim.

08Termination

Either party may terminate this agreement at any time. You may cancel your account through your account settings or by contacting us. We may suspend or terminate your access if you violate these terms, if your account is inactive for an extended period, or if continuing the service would be impractical or unlawful.

Upon termination, your right to access the platform ends immediately. We will retain Your Data in accordance with our data retention policy and applicable legal obligations. You may request an export of Your Data prior to termination.

Sections relating to intellectual property, limitation of liability, and any provisions that by their nature should survive termination will continue in effect after termination.
